  • There are interactions between individuals → Activities
    • Family, School, State, International levels

  • “Law” → Strict rules that people within the same society accept and agree to obey
  • These days, technology allow us to connect through internet.

Possible Interactions

  • Face-to-face communication
  • Via some means of communication
    • Traditional (e.g. Telephone ☎️)
    • Internet (e.g. FaceTime, ZOOM, Line, Video Call 📞)
  • When it comes to online interactions → More people can be connected, things happen faster.

Novel technology developed can be something that we can't currently imagine.

Law Development Process

  • Laws are developed based on possible problems found within society.
    • This creates good norms for people to follow,
    • If not followed, there are certain liabilities as defined by the law for specific offenses.
  • **There could be some "LOOPHOLES" in the law codes (i.e. Gaps in law)
    • Due to some issues that couldn’t be thought during the process of law legislation
    • or something that couldn’t possibly happen before!

Legal Terms

TermsDefinition
ContractA legally binding agreement between two or more parties, outlining the rights and obligations of each party. = สัญญา
OffenceA violation of the law; a criminal act or wrongdoing. = ความผิด
TortA civil wrong that causes harm, leading to legal liability for the person who commits the tort. = การกระทำละเมิด
Sui JurisThe legal capacity of an individual to manage their own affairs; a person who is legally competent and not under the control of another. = บรรลุนิติภาวะ
PunishmentThe penalty imposed by a court on an individual who is convicted of a crime = การลงโทษ
Legal personAn entity, such as a corporation or government, that is recognized as having legal rights and responsibilities. = นิติบุคคล
LitigantA party involved in a lawsuit; the plaintiff or defendant. = คู่กรณี, คู่ความ
CivilPertaining to legal matters that involve disputes between private individuals or entities, often seeking compensation or specific performance. = พลเมือง
CriminalPertaining to legal matters related to crimes, offenses against the state, with potential punishments such as imprisonment or fines. = อาชญากรรม
ActA formal written or unwritten decision or law created by a legislative body. = พรบ. (พระราชบัญญัติ)
JurisprudenceThe study and theory of law; the philosophy and principles underlying the legal system. = นิติศาสตร์
UnlawfulNot authorized by or in accordance with the law; illegal. = ไม่ชอบด้วยกฎหมาย
IncompetenceLack of legal capacity or ability; the inability to understand the consequences of one's actions. = การไร้ความสามารถ
LiabilityLegal responsibility for one's actions or debts. = ภาระผูกพัน - หนี้สิ้น
Natural personAn individual human being, as opposed to a legal person such as a corporation. = บุคคลธรรมดา
DefendantThe party in a legal action who is accused of committing a wrongdoing or crime. = จำเลย

Type of Law

1. Civil Law

  • Civil law deals with the disputes between individuals, organizations, or between the two, in which compensation is awarded to the victim.
  • Rights, duty, contract
  • Example: Tort Law, Commercial Law

2. Criminal Law

  • Criminal law is the body of law that deals with crime and the legal  punishment of criminal offenses.

Civil Law System vs Common Law System

Civil Law System

  • A legal system that relies heavily on written laws and statutes as the primary source of law. It is associated with a comprehensive legal code that outlines general principles and rules. ex. Thailand, France, Germany*
    • based on written laws ~ use law code ~ put law of the same categories in the same group
    • The courts also follow the Supreme Court’s precedents

Use written law

Common Law System

  • past legal precedents, or judicial rulings are used to decide cases at hand. Under civil law, codified statutes and ordinances rule the land. ex. United Kingdom, the United States of America, Singapore, etc.
    • based on court decisions, law declared by judges
    • based on accepted customs and traditions: there are new accepted new norms

Public Law vs Private Law

Public Law

  • deals with issues that are important to society as a whole, such as human rights or national security.
    • Juristic relation that are related to states
    • States or state-owned organizations have specific powers over their citizens.
    • In public law, evidence or proof might be unequally accessible.
      To ensure a fair solution, an inquisitorial system is suggested, allowing the court to call for evidence in the pursuit of justice, especially when evidence might be challenging to obtain.

Private Law

  • deals with issues that are specific to individuals, such as contract negotiations or property disputes. ex. person, company
  • Juristic relation between persons (can be natural or legal person)
  • Court of justice
    • Court of First Instance
    • Appellate Court
    • The Supreme Court (สูงสุด)
  • Uses accusatorial system for conducting legal procedure in the court.
  • The litigant must provide evidence, witness to the court

When all parties are private (ไม่เกี่ยวกับรัฐบาล เป็นเอกชนฟ้องกันเองเป็นต้น)

Substantive vs Procedural Law

Substantive Law

  • establishes the rights and obligations that govern the relationship between persons in the society
    • context of the law ex. Contract law, Criminal law, Tort law
    • Defines rights and duties; it's the "what" of the law.
    • It defines the legal relationship between individuals and provides the framework for legal actions.

Procedural Law

  • govern the proceedings and regulate how to precede cases, legal procedure to be applied and enforced, particularly in a court of law.
    • deals with the enforcement of Law that is guided and regulated by the practice, procedure and machinery.
    • Governs the process and methods for enforcing substantive law; it's the "how" of the law.
    • It establishes the rules and procedures that govern legal actions, including the steps to be taken in court.

Juristic Acts

Section 149: Juristic Acts are lawful and voluntary acts, the immediate purpose of which is to establish juristic relations, between persons to create, modify, transfer, preserve or extinguish rights.

Declaration of Intention

Section 168: A declaration of intention made to a person in his presence takes effect from the time when it becomes known to receiver of the intention. This also applies to the declaration of intention made by one person to the other through telephone, other communication devices or other means through which similar communication can be made.


มาตรา 168: การแสดงเจตนาที่กระทำต่อบุคคลซึ่งอยู่เฉพาะหน้าให้ถือว่ามีผลนับแต่ผู้รับการแสดงเจตนาได้ทราบการแสดงเจตนานั้น ความข้อนี้ให้ใช้ตลอดถึงการที่บุคคลหนึ่งแสดงเจตนาไปยังบุคคลอีกคนหนึ่งโดยทางโทรศัพท์ หรือโดยเครื่องมือสื่อสารอย่างอื่น หรือโดยวิธีอื่นซึ่งสามารถติดต่อถึงกันได้ทำนองเดียวกัน

Section 169: A declaration of intention made to a person NOT in his presence takes effect from the time when it reaches the receiver of the intention. It does not become effective if a revocation reaches him previously or simultaneously.

(Paragraph 2) Even though the person, who made a declaration of intention dies, become incompetent or quasi-incompetent by an order of the Court after it has been sent, the validity of the declaration is not impaired thereby.


มาตรา 169: การแสดงเจตนาที่กระทำต่อบุคคลซึ่งมิได้อยู่เฉพาะหน้าให้ถือว่ามีผลนับแต่เวลาที่การแสดงเจตนานั้นไปถึงผู้รับการแสดงเจตนา แต่ถ้าได้บอกถอนไปถึงผู้รับการแสดงเจตนานั้น ก่อนหรือพร้อมกันกับที่การแสดงเจตนานั้นไปถึงผู้รับการแสดงเจตนา การแสดงเจตนานั้นตกเป็นอันไร้ผล

(วรรคสอง) การแสดงเจตนาที่ได้ส่งออกไปแล้วย่อมไม่เสื่อมเสียไป แม้ภายหลังการแสดงเจตนานั้นผู้แสดงเจตนาจะถึงแก่ความตาย  หรือถูกศาลสั่งให้เป็นคนไร้ความสามารถหรือคนเสมือนไร้ความสามารถ

Wrongful Act

Section 420: A person who wilfully or negligently, unlawfully injures the life, body, health, liberty, property or any right of another person, is said to commit a wrongful act and is bound to make compensation therefor.

Legal Maxims

Legal Maxims


No crime, no punishment without law
If there is no law prescribed about a specific offense, that action is not a crime, then there’s no punishment

Application of Criminal Law

The Criminal Code of Thailand #LawCode


Section 2: A person shall be criminally punished only when the act done by such person is provided to be an offence and the punishment is defined by the law in force at the time of the doing of such act, and the punishment to be inflicted upon the offender shall be that provided by the law

If, according to the law as provided afterwards, such act is no more an offence, the person doing such act shall be relieved from being an offender; and, if there is a final judgment inflicting the punishment, such person shall be deemed as not having ever been convicted by the judgment for committing such offence. If however, such person is still undergoing the punishment, the punishment shall forthwith terminate.


มาตรา 2: บุคคลจักต้องรับโทษในทางอาญาต่อเมื่อได้กระทำการอันกฎหมายที่ใช้ในขณะกระทำนั้นบัญญัติเป็นความผิดและกำหนดโทษไว้ และโทษที่จะลงแก่ผู้กระทำความผิดนั้น ต้องเป็นโทษที่บัญญัติไว้ในกฎหมาย

วรรคสอง ถ้าตามบทบัญญัติของกฎหมายที่บัญญัติในภายหลัง การกระทำเช่นนั้นไม่เป็นความผิดต่อไป ให้ผู้ที่ได้กระทำการนั้นพ้นจากการเป็นผู้กระทำความผิด และถ้าได้มีคำพิพากษาถึงที่สุดให้ลงโทษแล้ว ก็ให้ถือว่าผู้นั้นไม่เคยต้องคำพิพากษาว่าได้กระทำความผิดนั้น ถ้ารับโทษอยู่ก็ให้การลงโทษนั้นสิ้นสุดลง

Criminal Liability

Section 59: (Paragraph 1) A person shall be criminally liable only when such person commits an act intentionally,

  • except in case of the law provides that such person must be liable when such person commits an act by negligence,
  • or except in case of the law clearly provides that such person must be liable when though such person commits an act unintentionally.

มาตรา 59: บุคคลจะต้องรับผิดในทางอาญาก็ต่อเมื่อได้กระทำโดยเจตนา

  • เว้นแต่จะได้กระทำโดยประมาท ในกรณีที่กฎหมายบัญญัติให้ต้องรับผิดเมื่อได้กระทำโดยประมาท
